Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Velisto (“Velisto,” “we,” “us,” or “our”), our website, and our application. By creating an account or using Velisto, you agree to these Terms. If you do not agree, do not use the service.

The service

Velisto is an AI-powered social media marketing platform for real-estate professionals. It helps you turn property listings into captions, images, videos, and other content, and lets you schedule, publish, and measure that content across connected social accounts such as Instagram, Facebook, LinkedIn, and TikTok. We may add, change, or remove features over time.

Accounts and eligibility

You must be at least 18 years old and able to form a binding contract to use Velisto. You agree to provide accurate and complete information when you register and to keep it up to date. You are responsible for maintaining the security of your account and for all activity that occurs under it. Notify us promptly if you suspect unauthorized use.

Subscriptions, billing, and refunds

Paid plans are billed on a subscription basis. Payments are processed by a third-party merchant of record acting as the seller of record for your subscription; your purchase is also subject to that provider’s terms.

Every plan comes with a 14-day money-back guarantee: if Velisto is not right for you, contact us within 14 days of your first payment and we will refund it in full. The guarantee applies once per customer, to the first payment of your first subscription. When a refund is issued, your subscription ends and your account and workspaces are closed.

You can cancel your subscription at any time from your account settings. When you cancel, your plan remains active until the end of the current billing period, and you will not be charged for the following period. Outside the 14-day money-back guarantee and except where required by law, fees already paid are non-refundable. We may change our prices or plans, and we will give reasonable notice of changes that affect you before they take effect.

Acceptable use

When you use Velisto, you agree that you will not:

• Send spam or unsolicited messages, or engage in deceptive or manipulative posting practices.
• Violate the terms, policies, or community guidelines of any connected platform, including Instagram, Facebook, LinkedIn, and TikTok.
• Post or publish content that is illegal, infringing, defamatory, discriminatory, or fraudulent.
• Upload content you do not have the rights to use, or that infringes another party’s intellectual property.
• Attempt to disrupt, reverse engineer, or gain unauthorized access to the service, or use it to build a competing product.

You are responsible for complying with the rules of the social platforms you connect. We may suspend or limit access to protect the service, our users, or third parties.

Your content and ownership

You retain ownership of the listings, media, captions, and other content you provide to or create in Velisto. To operate the service, you grant Velisto a worldwide, non-exclusive license to host, store, process, reproduce, adapt, and publish that content on your behalf — for example, to generate marketing assets, and to schedule and post to the social accounts you connect. This license exists only so we can provide the service to you and ends when you delete the content or close your account, subject to reasonable backup retention.

AI-generated content

Velisto uses AI to help create captions, images, and other marketing content. AI output can be inaccurate, incomplete, or misleading. You are solely responsible for reviewing and editing any AI-generated content before you publish it. You must not use Velisto to misrepresent a property — for example, by generating images that depict a property as something it is not — or to create any content that is false or deceptive. You are responsible for ensuring your published content is accurate and complies with applicable real-estate advertising and disclosure laws.

Service availability

Velisto is provided on an “as is” and “as available” basis. At this stage we do not offer a guaranteed uptime or service-level commitment, and the service may be unavailable from time to time due to maintenance, updates, or factors outside our control, including the availability of third-party platforms and AI providers. We do not warrant that the service will be uninterrupted, error-free, or that content will always be published successfully.

Limitation of liability

To the maximum extent permitted by law, Velisto and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business, arising out of or related to your use of the service. Our total liability for any claim relating to the service will not exceed the amount you paid us for the service in the twelve months before the event giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless Velisto and its owners, employees, and suppliers from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your content, your use of the service, your violation of these Terms, or your violation of any law or the rights of a third party, including the terms of any connected social platform.

Termination

You may stop using Velisto and close your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the service. Upon termination, your right to use the service ends. Sections that by their nature should survive termination — including content licenses granted to operate the service, limitations of liability, and indemnification — will survive.

Governing law

These Terms and any dispute arising from them are governed by the laws of [Jurisdiction to be finalized], without regard to its conflict-of-laws rules, and you agree to the exclusive jurisdiction of the courts located there.

Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you. Your continued use of Velisto after an update means you accept the revised Terms.
